Deed from Luke Gibbons Et al to John W. Cragg

This Indenture made in duplicate the twenty first day of April A.D. 1887.

In pursuance of the Act respecting Short Forms of Conveyances Between

Luke Gibbons of the Township of King in the county of York. Farmer James Gibbons of the Town of Ingersoll in the county of Oxford. Drover Mary O’Brien of the Township of Innisfil in the County of Simcoe, Widow, the Executors of the last will and testament of the late John Gibbons of the Township of Peel in the County of Wellington deceased hereinafter called the parties of the First Part.

Elizabeth Gibbons of the Township of Peel in the county of Wellington, Widow, hereinafter, called the party of the Second Part.

And John w. Craig of the said Township of Peel, merchant, hereinafter called the party of the Third Part.

Whereas the late John Gibbons who died on or about the 20th day of April 1883 was at the time of his decease duly seized in fee simple of the land and premises hereinafter more particularly described but subject to a mortgage made by said late Gibbons to one John Whyte of the village of Drayton in said County of Wellington, Merchant dated December 1st 1882 to secure $350 and interest thereon at seven percent said mortgage not being made to secure unpaid purchase money.

And Whereas the last will and testament of the said late John Gibbons duly made and published in his lifetime contains the following clause – I give and bequeath to my wife and children the use of my estate and property for the term of four years, at the expiration of the term of four years my executors hereinafter named shall if they think it prudent dispose of the property and divide it as follows. To my wife Elizabeth Gibbons one fourth if she shall remain my widow, to my daughter Mary one fourth, to my son John one fourth, and to my daughter Elizabeth one fourth.

And Whereas the parties of the first part are the executors of the said last will and testament and the party of the second part is the widow of said late John Gibbons.

Now this Indenture witnessed that in consideration of the sum of Two hundred and seventeen dollars of lawful money of Canada now paid by the said party of the third part to the parties of the first part Do Grant wit to the said party of the third part his heirs and assigns forever All and Singular that contain parcel or tract of land and premises situated as being in the Township of Peel in the county of Wellington and Province of Ontario contained by admeasurement three eighths of an acre be the same more or less, and which said parcel or tract of land and premises may be better known and described as follows that is to say being part of lot number thirteen in the tenth concession at the North west angle of said lot and bounded by allowance for road between concessions number ten and eleven one hundred feet and the allowance for road between lots twelve and thirteen in concession number ten one hundred and eighteen feet and the remaining two sides by lines respectively parallel to said two allowances for each.

To Have and to Hold unto the said part of the third part his heirs and assigns land for his and their sole and only use for ever subject nevertheless to the reservations limitations provisions and conditions expressed in the original part thereof from the Crown and to said before mentioned mortgage.

The said parties of the first part covenant with the party of the third part that the said parties of the first party will execute such further assurances of the said lands as maybe requisite.

And the said party of the second part in consideration of the premises and one dollar doth hereby grant release and quit claim with the said party of the third party and his heirs and assigns all dower and all right and title there to which she the said party of the second part nowhath with said lands before mentioned or can convey or could in right hereafter or anywise have or claimed whether at common law or otherwise now or ever to the land herefor mentioned.
