Telitha, having been appointed guardian in around 1853, sued as petitioner for Josephine and the other minor orphan children of James, alleging that proper accounting had not been made for funds due to the children, that there was a breach of the conditions of the guardianship bond, and naming the amount believed to be due.

James Madison Mathews' father was William Mathews, and named first son William Eldridge Mathews. I suspect that James Madison and William E. were brothers.

James Preston, through attorney Thomas Andrews, paid bond associated with a property dispute, where a claim in Superior Court against William E. Mathews, deceased, had been held in favor of the complaining merchants Scott Carhart and Company. The property was described as a house and lot in Knoxville where William E. Mathews resided when he died. These papers imply that the earlier Superior Court decision related to debt owed by William E. Mathews and awarded the property to the complaining merchant. James Preston, father-in-law of William E. Mathews, then gave an affadavit that the house belonged to him, not to William E. Mathews, and filed these papers making a claim on the property.2
