Last Will of Robert Clark

On this twenty seventh day of June, one thousand nine hundred and three, before me Cyrille Renaud, Public Notary residing in the parish of St. Ambroise, personally appeared Robert Clark, Farmer, residing in the Parish of St. Gabriel of Valcartier who being of sound and disposing mind, memory and understanding hath requested us, the said Notary and witnesses, to write down and receive in due form of law his last will and testament which he has declared in manner and form following:

 

1º I desire that all my just debts, funeral and testamentary expenses be paid by my Executor hereinafter named as soon as possible after my death.

 

2º I give and bequeath to my son James Clark, residing in said parish of St. Gabriel of Valcartier all my moveable and immoveable properties wherever the same may be and to whatever the same shall amount hereby constituting my said son James Clark my universal legatee.

I. This legacy is made by the Testator to the charge to support his mother, Dorothy Rourke, during her life, to procure to her every thing necessary to the life, and to take good care of his mother as a good son and these conditions sont de rigueur.

II. To the charge to pay the sum of one hundred dollars to my daughter Margaret Clark one year after my death.

III. To pay the sum of fifty dollars to his other sisters, Elizabeth, wife of David Hornby & Agnes, wife of Armand Harris, two years after my death.

 

I commute, constitute and appoint my said son James Clark as Executor of this my will and testament.

 

I revoke all will and testament I may have heretofore made and I declare the present to be my only true last will and testament.

 

Done and passed at Valcartier under Notarial Number two thousand five hundred and six,

 

And after the reading of the said testament to the said Testator in presence of James Clark and Henry Davis, both farmers residing at Valcartier, witnesses requested for the present will, the Testator having declared his inability to sign his name has made his mark in presence of the witnesses and Notary and the Notary and witnesses have signed in the presence of the Testator and in the presence of each other.

Notes by Patricia Balkcom:  Two of Robert’s children (John and MaryAnn) are not mentioned in the will.  Robert died the same year – December 10th – at the age of 71 years.  His wife died 9 days later.
