Land | 1 April 1860 | Burin, Newfoundland, Canada; This document implies that John O'Neill and Richard Marshall were trustees for Susannah (daughter of Isaac Penney and Elizabeth Huelan) Benning and possibly for their 12 children in case of her husband Clement Benning's death. Clement did die 5 years after this document was signed. Two years after his death, Susannah married John O'Neil, the trustee. The land sold in this document belonged to William Hooper, the husband of Richard Marshall's sister. Transcription of the document: "Wm Hooper To John ONeil & R Marshall Trustees This Indenture made the twentieth day April in the year of Our Lord One Thousand Eight Hundred and Sixty between William Hooper of Burin in the Island of Newfoundland Esquire of the one part and John ONeil and Richard Marshall of the same place Gentlemen Trustees as hereafter named of the other part. Witnesseth that the said William Hooper for and in consideration of the sum of Five shillings of current money of the said Island, to him in hand and truly paid by the said John ONeil and Richard Marshall the receipt and payment thereof and hereby duly acknowledge and released hath granted bargaines ? assigned ? and released and by these presents doth grant bargain sale assign ? and release unto the said John O'Neil and Richard Marshall their Heirs executors administrators and assigns all that piece or parcel of ground situate lying and being in Burin aforesaid in the same Island and bounded as follows that is today commencing at the angle formed in the South East side of the Public Road leading from Mr. P. Morris to the Court House and the ? or path lay leading from the same public Road to Mr. ONeil's Dwelling House thence by the said road to the small stream of water or brook on the south side of the said Road about thirty feet more or less from the corner of the store, including and comprising the whole dwelling House, Garden and small Meadow Stage Cove Wharf and Store, together with all the land wash and all the land formerly claimed by Richard Bishop situate to the East, South East and South including all that land in front of which the Weslayan Church formerly stood. Thus having as a separate and distinct peoperty of the whole of the land buildings gardens is situate to the South and North West of the said Public Road together with the right of the cove abutted to the East by Mr. O'Neil's Store and Wharf and the land back to the Public Road at Right angles with Mr. O'Neils Store on the West Side together with all and ? the Houses and Out Houses tenements ways Paths Waters Easements ? and appurtances whatsoever to the said piece ? and premises belonging or in any wise appertaining and the yearly sum of the rents issues and ? there of and every part and parcel thereof; and also all the estate rights and to the Interest trust ? claim or demand whatsoever doth at ? equity of the said William Hooper in or to on out of the said piece or parcel of ground tenements and premises and every part thereof. To Have and to Hold the said piece or parcel of ground tenements and premises with the appurtenances herein before mentined to be conveyed and granted unto the said John ONeil and Richard Marshall their Heirs executors and administrators and addings forever. And the said William Hooper for himself his Heirs executors and administrators doth hereby covenant with the said John ONeil and Richard Marshall their Heirs executors and administrators and assigns in manner following that is to say that the said piece or parcel of ground and premises hereby conveyed and assured are cleared of all encumbrances whatsover and that the said William Hooper ? himself good sight full power and authority to convey and assure the said piece or parcel and promises in manner aforesaid and that they the said John ONeil and Richard Marshall as such trustees their Heirs executors administrators and assigns shall and may from time to time forever hereafter quietly and peaceably have hold and occupy possess and enjoy the said piece and parcel of ground and premises with the appurtances so granted and conveyed as aforesaid for the uses trusts intents and purposes hereinafter declared concerning the same without the let trouble molesation or interruption of or by the said William Hooper his heirs executors adminstrators assigns or of or by any other person or persons lawfully claiming or to claim from by or under or in trust for him them or any of them or from by or through his or their ancestors or any of them and lastly that he the said William Hooper his executors or administrators and all other persons having or lawfully claiming or who shall or may have or lawfully claim any estate right title trust or interest at law or in equity of in to or out of the said piece or parcel of ground and premises with the appurtancesin any part thereof by or under on in trust for him them or any of them or by or under his or their ancestors or legal representatives shall and will from time to time and at all times hereafter upon any reasonable request and at the cost and charge of the said John O'Neil and Richard Marshall their their Heirs executors and administrators or assigns make do and execute all such further and lawful and reasonable acts deeds and conveyances in the law whathereon for the further better more perfect and absoute granting conveying and assuring of the same piece or parcel of ground and premises with the appurtances for who uses intents and purposes aforsesaid as by the said John O'Neill and Richard Marshall their Heirs executors and administrators or his or their Counsel ? in the law advised declared or required, promised always and it is here by declared and agreed on by and between the sais parties to these presents that the said land tenements and premises with the rights members privileges and appurtances so conveyed and described as aforesaid are to be held by the said trustees and the ? of them his executors administrators and assigns for ever. When such trusts and for such uses as are hereinafter declared of and concerning the same that is to say to use of Susannah Benning wife of Clement Benning Esquire of Burin aforesaid for her to take and receive from the said John ONeil and Richard Marshall or the survivor of them his executors administrators as such Trustees for her own use and benefit and that of her children begotten or to begotten by the said Clement Benning all the rents issues and profits of the said land tenements and premises for her and their support and maintenance during her natural life as long as they shall live with her unmarried and dutiful and ? of her suviving her siad husband then for and as long as she shall remain his widow and upon her death as such Survivor as aforesaid or second in marriage then to the use and ? of all said ? or such one or more of the children of the said Clement Benning of her begotten or to begotten and borne to be held and enjoyed him her and them and every of them share and share alike as trust in common till the youngest of them that attain the age of twentyone years then said land tenements and presmises shall be equally divided between them and the lawful children of such of them as shall be then dead. ? her children such division to be made by the said trustees in the ? of them. W. of Road in a SW Point Compass to a ? rock at the Wall across the marsha and from the second post in the garden fence for which said John O'Neil and Richard Marshall as Trustees ? said sight and interest to all the land situate to the S.E. of a line by compass, N.E. from the West point of what is known as the Back Cove to intesect Mr. ONeil's fence. The Memorial of William Penney of Burin fisherman: Humbly Sheweth That Isaac Penney Senr. late of Burin deceased, and with a Will, on the 27th March 1831 leaving three sons, George, William, your Memorialist, and Isaac, one of your Memorialists bondsmen. That your Memorialist was bequeath in by the said Will a Fishing Room, the only property therein mentioned, upon condition that George, your Memorialist’s brother did not take possession the said Room that Fall, that the said George at the time of the drawing of the Will was a resident of Lamaline, where he has intentioned to reside ever since. That by the said Will no Executor or Executrix was appointed. Your Memorialist therefor prays your Lordships will be pleased to Grant him Letters of Administration to the Estate of his late father and Your Memorialist as is duty bound will ever Pray. Obituary | June 2013 | Newfoundland, Canada; Anne St. Croix August 12, 1925 - June 19th, 2013 It is with great sadness we announce the peaceful passing of our mom, Anne St. Croix (nee Penton), while surrounded by her loving family, on June 19, 2013, at age 87 years. Predeceased by her husband Valentine (2002). Leaving to mourn her ten children: Ray (Patricia), Rita (Ned), Frances, Brian, Madonna (Shane), Josie (Rick), Robert (Joy), Paul (Dinah), Jerome (Josephine), Marcia (Gerard) and special nephew Gerald Penton (Lillian). She will be also greatly missed by her sixteen grandchildren whom she adored: Greg, Mark, Chris, Jeffrey, Tracy, Madonna, Nathan, Trevor, Keegan, Chad, David, Adam, Anne Marie, Jaime, Matthew and Steven, seven great-grandchildren and many other relatives and friends, including her special friend Eugene St. Croix and her Sunday Night ladies, Evelyn and Geraldine. Anne first met Val when she moved from Joe Batt’s Arm to St. Vincent’s in 1950 to work as a teacher. They later married and she settled down in St. Vincent’s to raise her large family. She was a very strong woman with a deep faith and a wonderful love of life: music, dancing, reading, cooking, and being with family were her passions. Cremation has taken place. Visitation will be held at the Father Battcock Memorial Chapel, St. Vincent’s, on June 23, from 1 - 4 p.m. 7 - 9 p.m. A celebration of her life and Mass of Christian Burial will take place at Sacred Heart Church, St. Vincent’s, on Monday, June 24, at 11 a.m. Private inurnment to follow. In lieu of flowers, donations in her memory may be made to the Ronald McDonald House or to a charity of one’s choice.
